TRAVELHORIZON CLUB’S
GENERAL TERMS OF MEMBERSHIP

IN EFFECT AS FROM JANUARY 17th, 2011

TRAVELHORIZON BV is a company incorporated under the laws of the Netherlands having its registered office at Randwycksingel 35, 6229 EG Maastricht (Holland), and registered with the Amsterdam Trade and Companies Registry under company number n° 33291866 (hereinafter referred to as « TRAVELHORIZON »).
Any Internet user wishing to become a member of TRAVELHORIZON’s club (“the Club”) must acknowledge they have accepted these General Terms of Membership (hereinafter referred to as the “General Terms of Membership” or “GTM”) by ticking the box provided for this purpose.
To become a Member of the Club, a person must be over 18 years of age and have the legal capacity to contract in compliance with the provisions of the General Terms of Membership.

Article 1: Definitions
- « Client »: designates any person who has registered on the Internet Site and bought a Holiday organised by TRAVELHORIZON from the Internet Site;
- « Member »: designates any physical person (this term strictly excludes legal entities, associations, organisations, groups or companies) who has correctly registered on the Internet Site with a valid e-mail address and has joined the Club;
- « Club »: designates the club exclusively reserved for the Internet users who have joined it, which offers specific services and advantageous promotional offers reserved for its Members;
- « General Terms of Membership »: designates the Club’s general terms of membership, such as stipulated by the present provisions;
- « General Terms of Sale»: designates the Internet Site’s General Terms of Sale;
- « Partie(s) »: jointly designates TRAVELHORIZON and the Client;
- « Holiday »: designates the touristic products sold by TRAVELHORIZON and available from its Internet Site, and in particular, accommodation offers, service offers and touristic package offers, excluding the products presented in the “Flight included” rubric, any option or service bought without accommodation, any cancellation, any product expressly excluded from the loyalty programme (such as those specified on the Site).
- « Internet Site » designates the Internet sites of the TRAVELHORIZON group, and notably, those available at the following web addresses : www.skihorizon.com, www.travelhorizon.com, www.spahorizon.com, www.net4ski.com, www.net4sea.com, www.totemvoyages.com, www.halloween.be. The Internet Site includes its infrastructure and its contents (and in particular, all texts, sounds and fixed or animated images).

Article 2 : Membership

2.1. Becoming a Member of the Club allows the Member to benefit from specific services, advantageous or exclusive promotional offers, and possible price reductions on certain Holidays. Those who are Clients also have the possibility to obtain and consult their travel documents.
2.2. To join the Club and benefit from possible price reductions, Members must fill in an on-line form and provide certain indispensable data.
Any membership registration submitted with an incomplete form or a form providing erroneous and/or unreliable data may be cancelled by TRAVELHORIZON without notice, and this cancellation shall not give rise to any indemnity.
When registering, the Member must enter a username and a password, which shall be unique and personal. The Member hereby undertakes that he/she will neither cede nor disclose them to any third party.
The Member furthermore undertakes not to duplicate his/her registration without TRAVELHORIZON’s prior authorisation.
The Members may at any time decide to withdraw from the Internet Site’s data base in the conditions provided for by these General Terms of Membership.
2.3. After the registration, the membership to the Club shall remain valid for an undetermined period of time.
2.4. A person is only entitled to register once as a Member. Under the term “person”, we understand an individual belonging to the same household (same name, same address, same e-mail address and/or a person who benefits from the same Holiday).
2.5. The Member has a retraction right: he/she may withdraw from the Club within seven (7) days as from the date he/she has joined it, by notifying this withdrawal by e-mail to the following address caroline@travelhorizon.com or by letter to TRAVELHORIZON, Randwycksingel 35 6229 EG Maastricht, The Netherlands.
When using part or all of his/her Loyalty Points, the Member looses his/her retraction rights.

Article 3 – Loyalty Points

3.1. Members receive Loyalty Points according to the terms provided by these General Terms of Membership (including its Annex A) in effect on the date of occurrence of the event causing the granting of such Points.
The number and validity of the Member’s Loyalty Points at a precise time will be specified in his/her « My Account » / « My Vouchers » rubric.
3.2. Loyalty Points are granted personally and may neither be ceded nor transferred to a third party.
3.3. Loyalty Points’ use and counter-value. Loyalty Points entitle Members to a price reduction upon the firm purchase of a Holiday on the Internet Site. The Loyalty Points’ value shall be directly deducted from the price when the Member orders a Holiday, according to the provisions of the General Terms of Sale and the General Terms of Membership (including the stipulations of Annex A of the GTM) effective on the date of the order. Loyalty Points having the closest expiry date shall be used in priority and they shall be deducted in priority from the handling fees, then from the price of the Holiday, up to their whole amount.

  • In case the Member exercises his/her withdrawal or cancellation right, the Loyalty Points shall not be used and the Member shall recover them for a future use, subject to their validity.
  • 3.5. Several Members may not combine their Loyalty Points for the purchase of one same Holiday.
    3.6. Duration and validity. Loyalty Points are exclusively valid during the Member’s membership to the Club and for two (2) years as from the date they are granted to the Member. In case the Member withdraws from the Club, he/she shall loose his/her Loyalty Points.
    3.7. Length of validity. The Loyalty Points are valid only during the registration period of the Member of The Club and for a duration of two (2) years after their granting. Any unsubscription to The Club implies the loss of all Loyalty Points.
    3.8 Use of your Loyalty Points at the payment:
    - The total amount of reductions the client can benefit from cannot exceed 10% of the displayed price of the booking.
    - The fidelity points held by the client at the date of the booking are applicable for a maximum of 10% of the total amount of the booking, including the use of promotional codes and other personal reductions.
    o Example1 : You have 60€ worth of loyalty points and the total payable amount is 400€. You can use a maximum of 40€ in loyalty points to pay this booking.
    o Example 2: You have 60€ worth of loyalty points and the total payable amount is 800€. You can use all of your loyalty points worth 60€ to pay this booking.

    Article 4 – Inviting new members

    4.1 “Inviting new members” is an invitation system which generates loyalty points for a Member if an individual joins “Le Club” after having been recommended by the Member. Members can invite internet users to join “Le Club” in order to become Members themselves. The “Invitor” is the Member who invites individuals to join “Le Club” and whose email address is given by the “Invitee” when he/she registers. The invited Members are called the “Invitees”, an “Invitee” can register when he/she has been invited to join by an “Invitor” and when he/she indicates the “Invitor’s” email address when registering. In this way, an “Invitee” can only have one “Invitor”, even if he/she has received invitations from several different Members. The “Invitors” are informed of the “Invitee’s” registration in the rubric
    « My Account/loyalty and invitations/invitations ».
    4.2 Only those known personally and physically to the inviting Member should be invited to join. The “Invitor” commits to sending invitations only to those whose email addresses he/she has obtained through personal relations with the email address holder.
    4.3 Upon the first completed purchase of over €60 (not including reductions applied beforehand) made by an “Invitee”, the “Invitor” will see Invitee Loyalty Points credited to his/her account as indicated in Annex A. He/she may be credited with as many vouchers as Invitees that he/she has invited.
    4.4 The “Invitee Loyalty Points” are valid for a period of up to two years (2) from date of issue.
    4.5 The inviting of large amounts of new members for direct or indirect lucrative gain by any means is strictly prohibited. If TRAVELHORIZON notices any serious irregularities in the use of the Invitation system, it may take any adequate measure to ensure that such irregularities cease, including the expulsion of the Member without any sort of indemnity for the Member.

    Article 5 – Protection of the User’s Personal Data

    5.1. The Site has been regularly registered with the Dutch Data Protection Authority (Dutch DPA).

      1. The data provided through the Site allow TRAVELHORIZON and its partners to process and fulfil the orders placed by their clients and to propose to them adapted services and offers. In compliance with the effective Dutch law concerning personal data protection (“Wet Besherming Persoonsgegevens”), the information indispensably required by TRAVELHORIZON and its partners for the membership’s processing and fulfilment are preceded by an asterisk in the pages of the Site. Any other data is optional but allows TRAVELHORIZON to understand its Clients better, to optimise the services it offers and to improve safety.

    5.3 In addition to the transmission strictly necessary for the membership, and subject to the Member’s prior agreement, TRAVELHORIZON may transmit to its commercial partner the data submitted by the Member.
    5.4 The personal information submitted by the Members may be used by TRAVELHORIZON for the sending of newsletters and the promotion of products or services similar to those provided by TRAVELHORIZON. Upon the sending of each of these e-mails, you will have the possibility to withdraw from the newsletters’ subscription file or to oppose the use and processing of your personal data.
    5.5 In compliance with the effective Dutch law concerning personal data protection (“Wet Besherming Persoonsgegevens”), you are entitled to accede to, to modify, rectify and suppress the data that you have submitted. You are also entitled to oppose the use and processing of your personal data by sending an e-mail to the following address caroline@travelhorizon.com or a letter to TRAVELHORIZON’s Customer Service Department Randwycksingel 35 6229 EG Maastricht, The Netherlands.

    Article 6 – Right of Modification

    6.1 TRAVELHORIZON reserves the right to modify the General Terms of Membership, at any time, and without further notification than the publishing of the General Terms of Membership on the Site, and to interrupt or terminate the loyalty programme, subject to the sending of an e-mail notification to the address declared to the Club. No modification, interruption or termination shall give rise to the payment of any indemnity, of any nature whatsoever.
    6.2 However, in the event of a termination of the loyalty programme, the Member shall keep all his/her Loyalty Points for their whole period of validity, until he/she has used all of them during such period of validity.

      1. Should these General Terms of Membership be violated/infringed, or improperly executed due to the occurrence of technical problems or any other event, TRAVELHORIZON reserves the right to rectify the number of Loyalty Points displayed on the screen and to replace it by the actual number of Loyalty Points granted to the Member in accordance with the effective General Terms of Membership/Sale. Should the Member obtain or use his/her Loyalty Points in contravention to the rules or in a fraudulent manner, TRAVELHORIZON reserves the right to cancel his/her membership to the Club. In such case, the Member would lose the Loyalty Points obtained in this manner without notice or indemnity.
      2. Any Member encountering a difficulty may send a claim within the shortest time frame by e-mail to the following address caroline@travelhorizon.com or by letter to TRAVELHORIZON, Randwycksingel 35 6229 EG Maastricht, The Netherlands.

    Special Conditions of the Operation « SkiHorizon 10 years» in force counting from 25 April 2011

    The Operation named « SkiHorizon 10 years » is a commercial, promotional and exceptional Operation taking place between the 13/09/2010 and the 31/08/2011 and is available on the following Websites :

    Article 1 : Definitions

    • « Client » : represents the physical person (excluding all corporate bodies, associations, organisations, groups or societies) who is a Member of the Club, has purchased for him/herself and friends or family, and who has completed in full (excluding all cancellations and refunds) one Stay or more offered by TRAVELHORIZON on its Website ;
    • « Member » : represents the physical person (excluding all corporate bodies, associations, organisations, groups or societies) who has completed a valid registration on the Website with a valid e-mail address and who has become a Member of the Club.
    • « Club » : represents the Club reserved for Member internet users, offering specific services and privileged promotional offers reserved for Members.
    • « General Conditions of Membership » or « GCM » : represents the general conditions of membership of the Club as published on the Website.
    • « Special Conditions »: represents the conditions applicable to the Operation defined by the current conditions.
    • « Duration of the Operation »: represents the Duration of the Operation taking place between midnight on the 13/09/2010 and midnight on the 31/08/2011, Amsterdam time.
    • « Operation »: represents the commercial, promotional and exceptional Operation named “SkiHorizon 10 years” of which the conditions and procedures are stipulated by the Special Conditions.
    • « Stay(s) » : represents the services and products offered for sale by TRAVELHORIZON and which are available on the Website, notably offers of accommodation, services or tourist packages, excluding Stays in the section marked « Stays with flights », all options or services purchased without accommodation, all cancellations, and all products or offers purchased which by nature do not lead to the acquisition of Loyalty Points and mentioned as such on the Website.
    • « Website » represents any one of the Websites of the group TRAVELHORIZON, notably those available at the follow addresses : www.skihorizon.com, www.travelhorizon.com, www.spahorizon.com, www.net4ski.com, www.net4sea.com, www.totemvoyages.com, www.halloween.be, www.sportura.nl, www.chalettravel.nl . The Website comprises of the infrastructure as well as the contents, in particular the texts, sounds and fixed or animated images.

    Article 2: Object
    The Operation consists of exceptionally granting Loyalty Points as defined in the GCM, in which the calculating method and the duration of validity are unique to the Operation and are fixed by the Special Conditions.
    As a consequence, all Loyalty Points granted by this Operation and un-used under these conditions will be deleted without any compensation for the Client or Member from the part of TRAVELHORIZON.
    All Members and Clients can take part in the Operation as well as all new Members subscribed during the Duration of the Operation.
    It is specified that:

    • only physical people over the age of 18 are eligible to participate in the Operation and
    • any person who has only taken part in a Stay or a reservation, made and/or reserved a Stay via a Works Council and staff members of Travel Agencies are not eligible for the Operation.

    The Loyalty Points granted definitively within the Operation are valid on all products – except Stays with flights – and can be cumulated with promotions and special offers but cannot be cumulated with card discounts and Work Councils.

    As stated in the article 3.8 of the GENERAL TERMS OF MEMBERSHIP: The fidelity points held by the client at the date of the booking are applicable for a maximum of 10% of the total amount of the booking, including the use of promotional codes and other personal reductions.
    o Example1 : You have 60€ worth of loyalty points and the total payable amount is 400€. You can use a maximum of 40€ in loyalty points to pay this booking.
    o Example 2: You have 60€ worth of loyalty points and the total payable amount is 800€. You can use all of your loyalty points worth 60€ to pay this booking.
    Article 3 : Operation procedure – Clients of the SkiHorizon, TravelHorizon, SpaHorizon, Net4ski and Net4sea brands
    During the entire Duration of the Operation, Loyalty Points acquired by the Client from midnight on Tuesday 06/09/2010, Amsterdam time, and of which the balance is available on his/her personal account accessible via the Website (hereafter represented as “Initial Balance”) can be multiplied by up to 10 (ten) according to the conditions and procedures determined hereafter.
    The Loyalty Points acquired in this manner will be credited to the Client’s account in the following way:

    • Loyalty Points acquired under the terms of the Operation : The Initial Balance is multiplied by 5 (five) counting from the 13/09/2010. Loyalty Points thus acquired are valid for use by the Client for all purchases of Stays until the 31/08/2011;
    • Loyalty Points acquired under the terms of the year following the Operation : In the event that the Client will have proceeded to purchase a Stay during the Duration of the Operation, the Initial Balance will again be multiplied by 5 (five) counting from the 13/09/2011. The Loyalty Points thus acquired and the Points acquired by the Client relating to the reservation of a Stay made during the Duration of the Operation will be valid for use by the Client until the 30/04/2012.

    If the Client does not proceed to purchase a Stay before the 31/08/2011, the Loyalty Points acquired by the Client under the terms of the Operation will be deleted and the Client will be left with the Initial Balance he/she had acquired as at the 06/09/2010.
    If the Client who proceeded to make a purchase during the Duration of the Operation does not proceed to purchase a Stay before the 30/04/2012, the Loyalty Points acquired in the year following the Operation will be deleted. The Client will keep the Loyalty Points acquired for the reservation of a Stay made during the Duration of the Operation.
    Any Points acquired outside of a reservation (for example Points granted as compensation for complete profile validation on the Website) are taken into account with the base of the calculation of Loyalty Points granted under the Operation. However, the aforementioned Points will not be taken into account with the base of the calculation of Loyalty Points granted in the year following the Operation. Only the fact of making a valid reservation (comprising of a reservation of a completed Stay neither cancelled nor reimbursed) during the Duration of the Operation will enable the multiplication of the Loyalty Points for the year following the Operation.
    If, on the 06/09/2010, the Client has less than 300 Loyalty Points in total, the Loyalty Points will not be multiplied by 10 (ten) as previously shown. However, TRAVELHORIZON will exceptionally grant him/her a number of Loyalty Points corresponding to the difference between 3000 and the number of Loyalty Points he/she has accumulated as at 06/09/2010, so that the Client will have a balance of 3000 Loyalty Points, valid for 1 (one) use during the Duration of the Operation. No supplementary Points linked with the Operation will be given to the Client during the year following the Operation.
    The Loyalty Points acquired under the Operation are valid on all brands participating in the Operation, during the Duration of the Operation and if necessary, the year following the Operation.
    Remarks

    • The Loyalty Points granted under the Operation are valid on all brands where the Operation is present and for all reservations made before the 31/08/2011, with the actual Stay taking place before or after the 31/08/2011. If the Stay is cancelled, the Loyalty Points granted under the Operation will also be cancelled and the Member will not receive any Loyalty Points in conformance with the year following the Operation.
    • The Loyalty Points granted for the year following the Operation are valid on all brands where the Operation is present for all reservations made before the 30/04/2012 with the actual Stay taking place before or after the 30/04/2012. If the Stay is cancelled, the Loyalty Points granted in conformance with the year following the Operation are also cancelled.

    Example :

    • The Client has 1200 Loyalty Points acquired as at the 06/09/2010 (made up as follows : 1000 Points acquired for a Stay + 200 Points for filling in his/her profile). These 1200 Points are multiplied by 5 (1200 x 5) = 6000 Points.

    • If the Client reserves a Stay (example of 1500€ granting 1500 Points in accordance with the GCM in force on the 06/09/2010) between the 13/09/2010 and the 31/08/2011 and doesn’t cancel his/her Stay, then the 7200 Loyalty Points will be used as a reduction on the price to be paid for the reservation. The 1500 Loyalty Points granted for the reservation afore named Stay will be granted on the return from the Stay.
    • In addition, the Client having proceeded to a reservation during the Duration of the Operation, will benefit from 5000 Loyalty Points (1000 x 5) on top of the 1500 Loyalty Points granted for the reservation of the Stay for the year following the Operation.

    Article 4 : Operation Procedure – Non-Client Members of SkiHorizon, TravelHorizon, SpaHorizon, Net4ski and Net4sea

    All Members who are not yet Clients will receive:
    - 9000 extra loyalty points if he/she subscribes before 30 April 2009
    - or 3000 extra loyalty points if he/she subscribes between 30 April 2009 and 1 September 2011
    These points can be used during the Duration of the Operation. After this period, the points are cancelled.
    Example: A Member has 200 Points for having filled-out his/her profile before the 06/09/2010. Thanks to the Operation, his/her account is credited with 3000 extra Loyalty Points, making 3200 Points in total.
    In the event that the Loyalty Points granted in this way are not used before the 30/04/2011, the aforementioned Points will be deleted.

    Article 5 : Operation Procedure – Members and Clients of other brands (Totem, Halloween, Sportura, Chaletravel)

    All Members who are not yet Clients will receive:
    - 9000 extra loyalty points if he/she subscribes before 30 April 2009
    - or 3000 extra loyalty points if he/she subscribes between 30 April 2009 and 1 September 2011
    These points can be used during the Duration of the Operation. After this period, the points are cancelled.
    Article 6 : Operation Procedure – Sportura, Chalettravel brands, Members without
    e-mail address

    The Clients and Members of these brands of which the e-mail address is not referenced by TRAVELHORIZON as a Member are invited to register to The Club to automatically benefit from the offer of the granting of 3000 Loyalty Points.

    All Members who are not yet Clients will receive:
    - 9000 extra loyalty points if he/she subscribes before 30 April 2009
    - 3000 extra loyalty points if he/she subscribes between 30 April 2009 and 1 September 2011
    These points can be used during the Duration of the Operation. After this period, the points are cancelled. Article 7 : General Conditions
    TRAVELHORIZON reserves the right, at any moment and without prior notice, to modify the Special Conditions with no notification other than the publication of the modified Special Conditions on the Website, which gives no right to any compensation of any kind.
    In the event of modifications to the current Special Conditions, the Member will keep the Loyalty Points granted under the Operation with the application of the Special Conditions before modification.
    In the case that the Special Conditions have been violated or executed in an incorrect way following technical or other problems, TRAVELHORIZON reserves the right to rectify the number of Loyalty Points granted under the Operation. In the event that a Member obtains or uses Loyalty Points in an incorrect or fraudulent way, TRAVELHORIZON has the right to cancel the Membership to The Club of the aforementioned Member, without compensation or prior notice.
    In the event of any difficulties, all complaints must be sent as soon as possible to the client service department by e-mail at the following address: caroline@travelhorizon.com or by post addressed to TravelHorizon BV, Randwycksingel 35, 6229 EG Maastricht, The Netherlands.
